FMLA requires that employers maintain FMLA forms and records for a three-year period. FMLA forms are an integral part of proper leave administration. Having a good record-keeping system in place protects employers against potential lawsuits and ensures compliance with FMLA regulations.

The Family and Medical Leave Act requires covered employers to provide up to 12 weeks of unpaid leave for a birth or adoption, to care for a close family member with a serious health condition, and for an employee’s own serious health condition. A number of additional federal laws must be taken into account when an employer is designing a leave policy or processing a leave request.

There are many FMLA forms used when an employee requests leave. For example, when an employee requests leave under FMLA, they should sign the “employees acknowledgement of review of the employers leave policies” to ensure that they have indeed received and read the company’s FMLA policies. These employees should also fill out the “FMLA request form”. If needed, the employer might also keep an “FMLA periodic status form” on file. FMLA administrative forms also include several FMLA trackers.
